If you co-own a property and one of you plans to sell their share, they should notify the other co-owners in writing. But what if the others already knew about the sale?

The Supreme Court of the Philippines recently made it clear:

If a co-owner already knows a sale happened but didn’t act within 30 days, a written notice is no longer necessary.

📌 Real Case Summary

  • Three relatives (two brothers and their aunt) co-owned a land in Aparri, Cagayan.

  • The aunt sold her share to someone else (Mr. Chua) — and had it registered under his name.

  • The brothers continued living on the land and were aware of surveys and legal complaints filed by Mr. Chua.

  • Years later, they tried to redeem or buy back the sold portion.

  • The courts rejected their request — because it was way past the 30-day redemption window.

🏡 What the Supreme Court Said

  • Normally, a written notice is required when a co-owner sells their share to someone outside the family.

  • The remaining co-owners have 30 days from notice to redeem the property.

  • BUT… if the co-owners already knew about the sale and still did nothing, the written notice can be skipped.

  • In this case, the brothers waited over 6 years — too late to act.

  • If you co-own a property, always stay updated on any planned sales.

  • Don’t wait — you only have 30 days to redeem once you know about a sale.

  • Even if there’s no letter or written notice, your awareness counts.

  • The court may deny your rights if you were aware and did nothing (this is called laches — or sleeping on your rights).
